This is all from their new sprinkler system.
Please accept the following complaint against the
Quick Trip construction project located at the intersection of Buttermilk Road and I-59 in Tuscaloosa
County. N 33.17065 W 87.44712 NPDES permit number ALR10BHQ0
1. Even after being cited and at least 3 complaints mentioning the lack of permit placard at the gate there is still no NPDES posted at the gate. Their civil engineer was onsite this week and should have taken care of that. This is a simple thing to fix but the polluter is still refusing to comply. From August 02 to the present 08/20/21 that’s 18 daily violations.
2. On 08/18/21, I visited the site and found red muddy water leaving their permit and flowing down the road into private property again. This time it wasn’t even raining. The mud flow was stemming from them watering the grass! This was done while workers were present and ignoring the responsibility to keep their pollution confined within their permit boundaries. If the BMP plan is so weak it will not even hold sprinkler water, it seriously needs revisited and revised. There is no excuse for damaging private property offsite and it's not even raining!
3. The drop inlet located in the first grassy area has been stopped up since my first complaint. It was also noted in Mr. Roberts report and shown in his photos. It, like many other problems at this site still exist and causing an intentional bypass of the erosion control measures.
4. This complaint doesn’t stem from a rain event. Them watering the grass caused this! The water ponded up around the compromised drop inlet and overtopped the slight berm on the downhill side of the inlet. You can see an erosion rill cut through the new dirt recently added and the water leading to the silt fence where it is passing under the fence, depositing mud and extremely turbid water into a public thoroughfare. The mud and dirty water accumulated on the private property across Valley Lake Rd and into the residential drives and yard.
5. There is still a large amount of gravel, sediment, and concrete washout material in the street and on private property offsite. The permit map shows the Valley Lake Rd to be a public ROW. It should not be part of their staging ground and washout area. Look at the permit, Pg88.
What this shows is a complete lack of concern for the residents, complete disrespect for ADEM and the NOV issued. This wasn’t even a rain event. It was careless and negligent. They know ADEM is not going to take any action so why bother to do it right.
I received the notice of my complaints with a notation at the bottom saying
“Evan Roberts
8/17/2021 Comments:
Previous NOV. Site was in compliance period at the time that the complaint was
received. Further decision will be taken at end of the compliance period,
depending on corrective actions by Operator.”
This complaint is outside the original arbitrary grace period given by ADEM but within extension of that period until Fri. COB. Quick Trip (QT) personnel intentionally left the sprinkler system running to the point where it caused sediment and turbid water to flow several hundred feet and across private property again. If the BMP plan will not hold the sprinkler water back, it certainly will not hold even a small rain event. No one was observed working on repairing BMPs. Many are still in the same condition as the first complaint of Aug 02, 2021. No attempt has been made to correct any BMP measures along the I-59 side.
From August 02 to the present 08/20/21, No NPDES, 18 daily violations.
Without
counting every detail I have seen that comes to 90 daily violations. There’s no
excuse for this. It’s time for ADEM to take deterrent action.
